Trademark Renewal

General Information:

  • The renewal process is straightforward. A petition must be filed with the Trademark Office within a year before the registration expires.
  • After the registration expires, a six-month period is available to request renewal of the mark by paying an additional late fee of US$10.00 per month. During this period, the registration will remain fully valid.
  • It is important to note that it is not mandatory to submit any evidence or declaration of use of a Trademark to obtain its renewal. Panamanian law does not provide a term to prove use after registration. However, the lack of use of a trademark for more than five consecutive years from the date of registration shall result in the cancellation of the registration. Cancellation may be requested by any natural or legal person who is considered to have the right to do so per the procedure established for claims of opposition.
  • The concept of use encompasses both international and domestic applications.
